Consumer’s right of withdrawal

Consumer obligations in the event of exercising the right of withdrawal 
Pursuant to Articles 52 et seq. of the Consumer Code (Legislative Decree No. 206/05 as amended by Legislative Decree 21/14), a Consumer who, for any reason, is not satisfied with the purchase made, has the right to withdraw from the order placed, without having to provide any reason, within 14 days from the day on which they received the ordered product (or the last product, batch or item in the case of multiple goods, batches or items delivered separately) or from the conclusion of the contract (including, by way of example and without limitation, contracts for the supply of digital content not provided on a tangible medium, such as a CD or DVD).
 
 
Withdrawal must be notified by sending a written communication via email to info@photo-xl.it, followed by a registered letter with acknowledgement of receipt to the collection point address:

The notice must contain an explicit statement of your intention to withdraw from the contract as provided for in Article 54 of the Consumer Code (as amended by Legislative Decree 21/14).
In order to exercise the right of withdrawal, the aforementioned notice must be sent before the expiry of the 14-day period and the product must be returned to Mr Video 2016 SRL in accordance with the procedures set out below.
The burden of proof regarding the exercise of the right of withdrawal lies with the Consumer.
The Consumer is required to return the goods without undue delay and in any event within fourteen days of the date on which they received the item in accordance with Article 54.
The deadline is met if the Consumer posts the goods back before the expiry of the fourteen-day period.
The Consumer shall bear the costs of returning the goods.
This right cannot be invoked by commercial traders.
 
Obligations of Mr Video 2016 SRL
The goods purchased must be returned intact and in their original packaging, complete with all essential parts of the product, as well as any manuals, cables, etc., with nothing missing.
The Consumer forfeits the right to exercise the right of withdrawal due to the lack of the essential condition of the goods’ integrity in cases where Mr Video 2016 SRL ascertains:
a) the absence of the original packaging;
b) the absence of integral parts of the product (accessories, cables, manuals, parts, etc.);
c) damage to the product caused by reasons other than transport;
d) the expiry of the time limit for exercising the right of withdrawal.
In such cases, the seller will return the purchased goods to the sender, charging the sender for the postage costs.
 
 
Exceptions to the right of withdrawal
The right of withdrawal does not apply in the case of:
  • The supply of sealed goods which are not suitable for return for reasons of hygiene or health protection and which have been opened after delivery.
  • Sealed audiovisual products, computer software, hardware and telephony products (including those supplied with hardware), once opened;
  • The supply of sealed audio or video recordings or sealed computer software that have been opened after delivery;
  • The supply of goods made to measure or clearly personalised.
 
 
Clarifications and conditions for exercising the right of withdrawal
This right applies to the product purchased in its entirety; it is not possible to exercise the right of withdrawal for only part of the purchased product (e.g. accessories, accompanying software, etc.);
Shipping, until the goods are received at our premises, is the Customer’s sole responsibility;
In the event of damage to the goods during transport, the seller will notify the Customer of the incident (within one working day of receipt of the goods), to enable them to promptly lodge a complaint against the courier they have chosen and obtain a refund of the value of the goods (if insured); in this event, the product will be returned, with shipping costs borne by the Customer, simultaneously with the cancellation of the withdrawal request; Mr Video 2016 SRL accepts no liability whatsoever for damage or theft/loss of goods returned via uninsured shipments;
Should the goods no longer be in perfect condition and/or be missing their original packaging, manuals and all items contained therein, Mr Video 2016 SRL may refuse to refund the sums paid by the Customer.
