. Introduction.
These terms and conditions for the website www.photo-xl.it apply to operations, transactions and purchases made in Italy. These terms and conditions are exclusive to www.photo-xl.it and, should they be deemed insufficient to comprehensively cover the rules and procedures governing online purchases on this website, you are required to comply with the relevant laws in force.
Where a specific transaction falls within the scope of these terms and conditions, no other terms or conditions shall apply.
Each individual transaction is to be considered a “purchase contract” and, as such, an “agreement between two parties”, and the terms of each purchase may not be amended unless by prior written agreement or confirmed email between the seller and the buyer.

The seller of the products offered via the website www.photo-xl.it is Mr Video 2016 SRL, with registered office in Rome – Via Taranto 21, 00182 Rome – VAT No. 13897331008 - Mr Video 2016 SRL, REA registration number RM - 1481434 and VAT number 13897331008, hereinafter referred to for brevity as “the company” or “photo-xl” or “www.photo-xl.it”. The procedures for registering and using the website to order, purchase and pay for items are determined in accordance with current regulations and can be consulted in the relevant sections on www.photo-xl.it Product descriptions All information relating to products and prices is subject to change without notice. www.photo-xl.it accepts no liability for inconsistencies and/or malfunctions and/or the display of website content that differs from what is published, due to the hardware and/or operating system, application, browser or any other type of software used by users.
The dimensions shown are approximate.

All products ready for immediate dispatch are available in our warehouse, except in exceptional cases where there are only a few items of the same product available and the purchase of that item or multiple items is made by the buyer immediately before, immediately after or at the same time as another buyer or buyers.

For products “available to order”, dispatch will take between 7 and 10 working days, except in exceptional cases where the required lead times will be communicated.

For added certainty, should you require urgent availability of the purchased item for professional reasons and/or personal reasons linked to a special event such as a birthday, anniversary or any other special occasion, we recommend contacting our customer service team at info@photo-xl.it

Prices
The price of the products shall be as stated on the invoice.
VAT shall be payable at the rate indicated on the invoice.
All prices are quoted in euros. Product Availability Should the item be unavailable, Photo-xl shall notify the purchaser within 48 hours, indicating, where possible, the estimated waiting time for the order to be fulfilled. Should the customer inform Photo-xl that they are not willing to wait for the specified period, the contract shall be deemed terminated and any payment made will be refunded.
Should the item be available but the purchaser wish to cancel the shipment, the cost will not be charged to the purchaser only if the item has not already been handed over to the designated courier.
 
Order and payment
The customer confirms their order as follows. Customers wishing to purchase a product or service for sale on the website www.photo-xl.it must follow the procedure below to complete the order. After clicking the ‘Confirm’ icon and verifying the accuracy of their order details, the customer confirms their selection of the chosen product(s) with a click. If this is the first order, the customer must complete a personal information form: surname, first name, full delivery address, email, date of birth, telephone number. During the process, the customer also creates a password.
The customer may pay for the purchased products using the following NON-BINDING methods for www.photo-xl.it:

www.photo-xl.it reserves the right to cancel a transaction and suspend the dispatch of an item even without providing specific details and/or justification to the customer.
Please note that the website www.photo-xl.it has been built using the most modern anti-fraud software (to protect both customers and the Company) provided by the credit institutions that collaborate with
www.photo-xl.itDopo. Once a payment method has been selected, the customer definitively and irrevocably confirms their order, with the effects set out below and common to all online purchasing procedures.
Such confirmation implies acceptance of these general terms and conditions of sale.

Payment by credit card on the website
The customer confirms their delivery address and (if different) billing address, the product or service purchased and the total price. The customer provides their credit card number, together with the expiry date and CVV code. Finally, they confirm their order by clicking on the "Confirm" button. www.photo-xl.it reserves the right to refuse to fulfil an order placed by a consumer who has not paid, in full or in part, the amount of a previous order, or with whom payment disputes are ongoing, without the need for third-party consent, and to notify the customer if they cannot be contacted.

Payment verification
www.photo-xl.it carries out checks on all orders confirmed on its website.
These checks are designed to protect transactions from any illegal activities carried out by malicious users. Our staff are authorised to request information necessary to release an order, including: proof of address or a direct debit in your name, or proof of address in the name of the person named for the delivery address. PAYMENT

METHODS No payment details, serial numbers or sensitive data relating to the payment method are stored by
www.photo-xl.itAlt the time of payment, the Customer is redirected to a specifically encrypted banking portal dedicated to online purchases.
Payments must be made using VISA or Mastercard credit cards. The security of the transaction is guaranteed by an encrypted payment system with security codes and carried out via an SSL (Secure Sockets Layer) system.
The transaction is therefore considered more secure than a traditional credit card payment made in any retail outlet, as no operator comes into contact with your credit card.
TERMINATION


CLAUSE Failure to pay or the non-completion of the payment arranged by the purchaser shall result in the automatic termination of the contract due to the purchaser’s breach of contract pursuant to Article 1456 of the Italian Civil Code and subsequent updates and amendments, without prejudice to compensation for further damages by www.photo-xl

.it DELIVERY TERMS
We advise the customer that, in the event of damaged packaging, it is mandatory and essential for the purposes of any subsequent replacement of the item to request the inclusion of a note bearing the wording “packaging damaged on delivery” on all copies at the time of signing the delivery note.Purchased items are collected by the best national couriers appointed by Photo-xl, who will deliver them to the buyer.
From the time of dispatch until delivery of the item, Photo-xl provides the Customer with a parcel tracking system which the Customer may consult whenever they deem it necessary.

SHIPPING
Shipping will be via express courier (Bartolini) within 24–48 working hours for products marked as “ready for delivery”, whilst items marked as “available to order” will generally be delivered within 7–10 working days (subject to availability from the parent company).

Shipping costs €12.00 including VAT.

COPYRIGHT, TRADEMARKS AND OTHER INTELLECTUAL PROPERTY RIGHTS This Website as a whole, and all material contained therein, is protected by copyright and other intellectual property rights. Duplication in any form is therefore prohibited, except for strictly educational purposes. 
The photo-xl trademark is an exclusive trademark owned by Mr Video 2016 SRL.
This Website may contain links to other websites (“Links”). Photo-xl accepts no responsibility for the content and materials accessible on such sites or otherwise obtainable through them. This Website may also contain information from third-party sources, to which you must refer exclusively for any matters concerning their accuracy, truthfulness and completeness. Photo-xl reserves the right to modify the Website and its contents at any time without any obligation to provide prior or subsequent notice. 

Liability and Warranties
The products or services purchased by the Customer are covered by the manufacturer’s or importer’s warranty and support, as provided for by current legislation. 

LIMITATION OF LIABILITY
Photo-xl guarantees the return or replacement of the purchased goods solely for the economic value of the goods themselves and is hereby released from any further liability for any additional damages the Customer may claim. 
In cases not specifically listed, Photo-xl shall in no way be liable for any costs relating to shipping, storage, warehousing or the search for the purchased item.
In any exceptional circumstances relating to delivery, such as loss or theft, the courier responsible shall be liable.


APPENDIX TO THE RIGHT OF WITHDRAWAL
The purchaser has the right to withdraw from the contract of purchase for any product and/or service provided by Photo-xl pursuant to Article 64 of Legislative Decree 206 of 6 September 2005, by giving written notice via registered letter with acknowledgement of receipt posted within 14 days of delivery of the goods and addressed to: Mr Video SRL - collection point - Via di Torre Morena 83D - 00118 Rome. The customer may also withdraw by giving written notice to the company within 14 days of delivery of the purchased goods, by email or fax, provided that the notice of withdrawal is confirmed by registered letter with acknowledgement of receipt posted within the following 48 hours. The notice of withdrawal must contain: - the code of the purchased item to be returned, and the information necessary to process the refund, which will be made by bank transfer: (First name and Surname or Company Name - full address - ABI-CAB-Account No.-IBAN). Should the purchaser fail to provide the information necessary to process the refund, or provide it incorrectly or incompletely, Mr Video 2016 SRL may be unable to process the refund. In such a case, Photo-xl shall not be held liable for any delay in the refund. In the event of withdrawal from the purchase of items already delivered, the shipping costs will be charged to the customer. The purchaser shall be liable for any additional costs incurred by Photo-xl due to incorrect or incomplete provision by the purchaser of the information required for the refund. JURISDICTIONThis contract is governed by Italian law. In the case of a consumer, the court of the consumer’s place of residence or domicile shall have jurisdiction, provided this is located in Italy. For any other dispute, however, the Court of Rome shall have jurisdiction.

WITHDRAWAL The period within which a refund will be issued is 14 calendar days;
